From February 14, 2026, Vietnamese tax law introduces a new provision aimed at reducing administrative penalty risks for taxpayers.
Accordingly, taxpayers who are required to resubmit tax returns due to changes in the tax period will not be subject to administrative penalties for late submission of tax returns.
This regulation is particularly significant for enterprises, business households, and individual taxpayers.
Taxpayers will not be penalized if the resubmission of tax returns results from:
Changes in the tax period in accordance with the law
Adjustments required by tax authorities
Changes in the tax declaration method leading to resubmission
In these cases, resubmission is not considered an administrative violation.
It should be noted that:
The exemption applies only to penalties for late submission of tax returns
It does not exempt taxpayers from tax obligations
It does not apply to cases of incorrect declaration, tax evasion, or fraud
Misinterpretation may still result in legal risks and tax reassessment.
This regulation helps to:
Reduce penalty pressure during tax return adjustments
Encourage proper compliance with tax obligations
Minimize unnecessary administrative disputes with tax authorities
However, taxpayers must still comply with procedural and timing requirements for resubmission.
To ensure tax compliance and legal safety, GIVLAW recommends:
Clearly identifying the legal basis for changes in the tax period
Maintaining complete records and supporting documents
Consulting legal professionals when resubmission of tax returns is required
Legal prevention is always more effective than post-violation remediation.
