In land dispute cases in Vietnam, some disputes are not finally resolved at the district or provincial level. When a land user disagrees with the land dispute resolution decision issued by the Chairperson of the Provincial People’s Committee, Vietnamese law allows the case to be complained to the Minister of Agriculture and Environment.
In practice, many applications are rejected or delayed due to incomplete or improperly prepared dossiers.

Relevant legal regulations on land dispute resolution and complaints
According to Decision No. 2304/QD-BNNMT, the dossier for resolving land disputes under ministerial authority consists of two main groups of documents:
Request for Land Dispute Resolution (01 original copy)
The request must clearly state:
Full name and address of the applicant
Location, area and current status of the disputed land
Reasons for the dispute
Specific request for ministerial review
List of supporting documents and evidence
Land Dispute Resolution Decision issued by the Provincial People’s Committee (copy)
This decision is a mandatory requirement. Without it, the complaint dossier will not be accepted for review at the ministerial level.
Minutes of mediation at the commune-level People’s Committee (copy, if any)
These minutes demonstrate that the dispute was previously mediated at the local level.
Documents proving land use rights (copies)
Pursuant to Article 137 of the Land Law 2024, these documents serve as key evidence of the lawful and stable use of the land.
Land administration and cadastral records
On-site verification reports
Opinions from relevant specialized authorities
Filing the dossier with the wrong authority
Missing the provincial-level dispute resolution decision
Insufficient evidence of land use rights
