According to Clause 9, Article 2 of the Law on Residence 2020:
Temporary residence refers to the place where a citizen lives outside their permanent residence for a certain period and has completed temporary residence registration.
Temporary residence registration is the act of declaring one’s current place of residence to the competent police authority.
A citizen must register temporary residence when they move to live at a lawful residence outside the commune/ward where they hold permanent residence, for work, study, or other purposes for 30 days or more.
Subjects required to register:
Vietnamese citizens aged 14 and above
Foreigners and overseas Vietnamese temporarily residing in Vietnam
Mandatory deadline:
Within 30 days from the date of moving to the new residence.
Ensures rights related to residence, healthcare, education
Required for procedures such as ID card issuance, social insurance records, administrative documents
Prevents deletion of temporary residence status
Avoids penalties under Decree 282
Supports State management of local security and order
According to Clause 1, Article 27 of the Law on Residence 2020:
The tenant is the one obligated to register temporary residence, not the landlord.
Landlords are not legally required to register on behalf of tenants, though they often help due to familiarity with the process.
Responsibility of each party:
Tenant → obligated to register temporary residence
Landlord → obligated to report lodging information
If neither party performs temporary residence registration or lodging notification, Article 10 of Decree 282/2025/ND-CP imposes penalties:
1. Warning or fine from VND 500,000 to VND 1,000,000 for:
a) Failure to comply with regulations on permanent residence registration, temporary residence registration, residence deletion, household separation, residence information declaration, or adjustment of information in the Residence Database;
b) Failure to comply with lodging notifications or temporary absence declarations;
c) Failure to present residence documents or digital residence information (VNeID) when requested.
Tenant: VND 500,000 – 1,000,000
Landlord: fined the same range for failure to report lodging
Landlord as an organization: VND 1,000,000 – 2,000,000
Under Article 27 of the Law on Residence 2020, a tenant may register temporary residence when:
They have lived at a lawful residence for 30 days or more
They are not prohibited from registering temporary residence under Article 23 (illegal construction, encroached property, etc.)
Temporary residence duration: up to 2 years, renewable multiple times
Tenants must renew at least 15 days before expiration to avoid deletion.
According to Article 28 of the Law on Residence 2020:
Documents include:
Declaration of residence information changes
For applicants under 18 → consent from parents or guardian
Documents proving lawful residence, such as:
Land/house ownership certificate
House rental contract
Permission to stay granted by homeowner
Housing allocation documents
House purchase/gift/inheritance documents
Tenants submit to the Residence Registration Authority, i.e., the local commune/ward police.
Declaration of residence information changes – Form CT01
Proof of lawful residence (rental contract, lodging agreement)
Submit directly to the residence registration authority.
If complete: issue a receipt and schedule notification
If eligible but documents are incomplete: request supplementation
If ineligible: issue written refusal stating reasons
Fees depend on application method:
Online registration via VNeID:
Group registration: 5,000 VND/person/time
Individual/household: 7,000 VND/person/time
Steps to register via VNeID:
Log into VNeID
Choose “Administrative Procedures” → “Lodging Notification” → “Temporary Residence Registration”
Select “Create new request” and fill out the online form
Upload scanned copies/images of proof of lawful residence
Submit and receive results
At the government office:
Group registration: 10,000 VND/person/time
Individual/household: 15,000 VND/person/time
Within 03 working days, the authority must update the temporary residence information in the Residence Database and notify the applicant.
Applicants collect the notice according to the scheduled date stated on the receipt.
